Role and scope

StateNull is a software solution provider. StateNull provides technical tools to request, capture, organise, encrypt, transmit, retain, review and verify records. StateNull does not act as your lawyer, clinician, care provider, insurer, loss adjuster, employer, safety officer, regulator, law-enforcement agency, evidence custodian, certification body or professional reviewer. StateNull does not determine whether content is true, whether work was performed correctly, whether a legal or professional duty was met, whether a claim should be accepted, whether evidence is admissible, or whether an official chain of custody has been established.

Your responsibility

You control your use. You are responsible for determining whether StateNull is suitable for your purpose and for configuring and using it lawfully. You are responsible for your content and instructions; authority to collect and share it; required notices, permissions, legal bases and consents; data minimisation; professional review; access controls; retention and deletion; required reporting; disclosure; export to official systems; and compliance with applicable law, contracts, licences, professional rules and organisational policies. You must maintain any official clinical, personnel, safety, regulatory, case, asset or evidence record required for your activity. A StateNull template or technical status does not replace that official system or professional judgement.

Allocation of data-protection roles

Data-protection roles depend on the activity. For customer content, the customer normally determines the purpose and essential means of processing and is responsible for the corresponding controller duties. Where StateNull processes customer content on documented instructions, StateNull acts as processor and remains responsible for the duties that apply to processors. StateNull acts as controller for personal data it processes for its own account administration, billing, security, abuse prevention, legal compliance and service operations. No checkbox transfers duties that applicable law assigns to either party. The applicable Data Processing Agreement forms part of the business service terms where required.

Risk allocation and liability

Operational decisions remain yours. To the maximum extent permitted by applicable law, StateNull does not assume responsibility for your professional, operational, legal, clinical, employment, insurance, safety, regulatory, investigative or evidentiary decisions, or for consequences caused by your unlawful or unauthorised content or use, your failure to obtain required authority or notices, your failure to maintain required official records, or your reliance on a technical indicator as a professional or legal determination. You bear the operational risk of selecting and using the Service for your particular purpose.

The Service is provided as available and without guarantees of a particular legal, professional or business outcome. Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, including liability for intent or gross negligence, injury to life, body or health, mandatory product liability, applicable data-protection liability, or mandatory consumer rights. StateNull remains responsible for its own obligations under applicable law and the express commitments it makes in the agreement.
